Gamecyte is reporting that Monte Morgan is suing Harmonix, MTV, EA and Viacom. The suit alleges that the various partners in Rock Band conspired to cheat customers by shipping defective drum pedals.
"Due to a design defect, the bass drum foot pedal (which is an integral component of the Rock Band drum kit) fractures under ordinary and expected usage, thus rendering the pedal inoperative," states the suit. "Without a functioning bass drum foot pedal, consumers are unable to use the Rock Band drum kit or play the Rock Band game in the manner marketed and advertised by Defendants, thus depriving them of the value and enjoyment of their purchases."
Much of the suit centers around the warranty expansion for Rock Band's bass pedal, which expired nigh simultaneous with the release of Rock Band 2 and its superior bass pedal. The defendants are seeking an injunction against the game, along with unspecified damages and restitution. The full legal complaint can be read here.
