Daily Games News is reporting that a lawsuit has been launched against Microsoft for the large number of Xbox 360 hardware failures. This suit is being brought forth in Sacramento County Superior Court, citing Californian consumer protection statutes.
The class action suit not only admonishes Microsoft for the shoddy quality of the Xbox 360 hardware, but also cites stories from VentureBeat, which claim that Microsoft knew about the problems but released the console anyway in order to beat the PS3 and Wii to market.
The suit is seeking an order for Microsoft to relinquish all profits gained from Xbox 360 sales and that the company issue a refund program in the state of California.

you know i'm not very suprised of this. my wife and I called the xbox toll-free number and there representatives are very rude. We called and sent our 360 in, then when we go it back and plugged back got the ring of death again. We called xbox back and they had accused my wife of doing things with the xbox unit to cause the ring of death. maybe that's probably the reason why a friend of ours called up and told them to f--- off. customer service is not what i t used to be.
I don't care how good you take care of your XBOX360, if it's going to Red Ring, there's nothing you can do about it. As I said, Microsoft isn't skipping making a profit off our our faulty consoles because of something WE did. It's COMMON KNOWLEDGE. So why are you people so clueless?
you have to also take consideration into haw you treat your console. if the 360 isnt getting enoungh ventalation, the risk for the fialure is greater. the best way to leave it is not verticlt, because the main cooler on the xbox is on the bottom. if you play the xbox for 12 hours at a time (witch i feel bad for you if you do) take some time too ventalate it and turn it off. my xbox is perfectly fine because i keep good care of, screw the lawsuit.
yes you can imstuck4evragain...yes you can....hahaha people are ridiculous. To suggest that ALL profits from the sales of the 360 are refunded is preposterous its not like all of them were faulty. I've left my 360 on for like a day and a half and never red ringed ::knock on wood:: so the amount of use or being on doesn't seem to be a reliable factor as to why people get the R.R.O.D.

Most of the people commenting here are uninformed idiots. At the time the 360 shipped, fully SIXTY-EIGHT OUT OF ONE HUNDRED CONSOLES were coming off the assembly line non-functional. They shipped anyways so that they could beat Sony and Nintendo. And 360s are just computers. They don't care if you leave them on all day long. That doesn't cause a hard drive failure in your PC, and it won't cause it in your 360, either. MS shipped a lot of them out with faulty hardware. And the reason the lawsuit is only in CALIFORNIA is because it's California that has the law that protects against consumers being abused by a company selling a shoddy product witout taking responsibility. Why should MS have profited on a piece of trash? And just for the record, I am anti-stupid lawsuits just for personal gain, so it's not like I think everyone who thinks they can get a buck out of someone should sue.
pretty freakin stupid if you ask me. Ive had my 360 for nearly a year now and it has never red ringed... i am pretty how the player treats it has something to do with it, because i feel like plenty of people get red ringed before then.
soxtober07, im kinda curious as to how intercoolers r at fault for INTERNAL HARDWARE problems, ive personnally had to fix over 40 xbox 360's between all my friends and my own 360's. only about a quarter of these 360's had intercooler's on them, and with the exception of a couple people, none of us had our consoles on for more than about 4 hours within a day. so where to u get ur information? make it up and hope it sounds good?
SOXTOBER: You are dumb and wrong. The XBOX Malfunctions are MICROSOFT'S Fault. Not ours. You are aware they extended the warranty by 3 years to correct these problems and they also give free gifts when they return the consoles. You want to know why they did this? Because it was a mistake on their part and they're trying to fix it. They don't do all of this because it's the consumers fault for PLAYING THE CONSOLE TOO LONG. Are you ignorant? This is common knowlege that it's Microsofts fault with how they used this piece in the system that melts rather easily. Research or look stupid. :)
wow, people sue for the most ridiculous things. people have to understand that you only get the red rings of death if you: A. used an intercooler for your 360 OR B. you spend all your day playing video games and you have no life. so it's really not microsoft's fault for that. because nyko created the intercoolers, and people spend all their time playing video games which is pathetic.
