Daily Games News is reporting that a lawsuit has been launched against Microsoft for the large number of Xbox 360 hardware failures. This suit is being brought forth in Sacramento County Superior Court, citing Californian consumer protection statutes.
The class action suit not only admonishes Microsoft for the shoddy quality of the Xbox 360 hardware, but also cites stories from VentureBeat, which claim that Microsoft knew about the problems but released the console anyway in order to beat the PS3 and Wii to market.
The suit is seeking an order for Microsoft to relinquish all profits gained from Xbox 360 sales and that the company issue a refund program in the state of California.

I have had to send in our 360 elite (3) times for the RROD and NOW there is a media read error!!! Our 360 has spent MORE time in transit than in our home!! The kicker is MS informed me that we are expected to shell out repair fees because, this is the good part, our warranty expired in February! Our 360 was STILL being repaired for the RROD in Feb!!! WTF? Anyways, we along with MANY others I'm sure, haven't had to send in Either our Nintendo OR Sony Console... EVER!!! Gates probably couldn't care less because as the obviously VERY securely employed customer service associate stated "If you decide to change your mind we'll be here." NO Kidding!! Best wishes to those willing to keep taking it up the ??? Personally I have chosen NOT to!!
I also wonder why if they were so shoddy, why nobody chose to get there money back within the reasonable time allowed by most states' statutes. Most big name stores like best buy etc have a 14 day at LEAST return policy no questions asked. If you opened it up, found out it didn't work. You would go back and return it and get your money back immediately. CAVEAT EMPTOR! "BUYER BEWARE!"

wow they adhered to the right to cure policy of business law: They sent out packages post marked with paid shipping and paid the return shipping and took care of the problem. They also offered a 2 year warranty to boot. I don't see how this law suit is going to go anywhere. They have done everything under the UCC to rectify the situation. It's not like they aren't honoring their warranty...
poor service my ass they way too expensive too have problems like that i mean the ps3 has had its fair amount of problems yet iv never had better customer service.

Just another reason why i stick with Sony, plus if im right last time i heard they fired a guy working for Microsoft because he gave information out about the Red Ring of Death to the public. Apparently they weren't supposed to know about it and fired him of reasons called called "Company Secrets"

I used to work in a video game store. A few things I learned are that the Intercoolers really are poorly made, but I saw just as many 360's fail because of poor ownership. Sony had just as many problems with the PS2 and they never got sued; there should be no reason why Microsoft should be held liable with such a long warranty now available. At least they took responsibility for their wrong-doings. I would love to see some better customer service, but it is not Microsoft's fault that a bunch of idiots don't know how to handle an XBox. I hope the lawsuit gets thrown out.
